In Canada, Delta 9 THC has been legal at a federal level since the Cannabis Act of 2018. This means that cannabis and therefore Delta 9 THC is fully legal for recreational use for users that are at least 18 years of age in Alberta and Manitoba, 19 years of age in all other provinces except Quebec which is 21 and older.
In comparison, cannabis in the United State sis still not legal on a federal level yet. This means that each state has it’s own rules when it comes to recreational cannabis and how it is handled. However, there is one important distinction that needs to be made, and that is the Farm Bill of 2018.
Hemp Derived Cannabinoids in the USA
In the United States, a law was passed in 2018 that left the door open for smart entrepreneurs to leverage a loophole. This loophole allowed all hemp derived products that contain less than 0.3% THC to be permitted for federal use and consumption. What they didn’t realize is that there were lesser known cannabinoids such as Delta 8 THC, Delta 10 THC, and THCV that could be extracted. These extractions are all hemp derived and contain less than 0.3% Delta 9 THC, which is still federally illegal.
Medical vs Recreational Marijuana
In Canada, medical marijuana has been legal for many years. In the United States, certain states have permitted medical marijuana for patients as well. Eventually, we may see the US go at least federally legalized within the next 5 years (don’t hold us to that though).
